Terms and Conditions

Preamble
These general terms and conditions of sale are agreed between Toys "n" Us , represented by Vânia Raquel Pinto Marques, Tax Number 241523044, with registered office at Estrada de Travanca, 161 - 4520-810 Travanca and contact email sexshop @toys-n-us .com , hereinafter referred to as the "Online Store", and people who wish to make purchases through the Online Store, hereinafter referred to as the “User”.
The parties agree that purchases made through the Online Store will be regulated exclusively by this contract, excluding any conditions previously available in the Online Store.


ARTICLE 1. PURPOSE
These general terms and conditions of sale aim to provide and define all the information necessary for the User regarding the methods of ordering, selling, paying for and delivering purchases made in the Online Store.
These conditions regulate all the steps necessary to place the order and guarantee its follow-up between the contracting parties.


ARTICLE 2. ORDERING AND INVOICING
The User completes his/her order through the purchase process presented in the Online Store, adding the desired product(s) to the shopping basket.
To send your order, the User must:

a) Register in the Online Store, providing the requested information;
b) Log in (combining the email and password chosen during registration);
c) Complete the necessary information (delivery and billing address, shipping and payment method, NIF and name for the invoice).

Final confirmation of the order is equivalent to full and complete acceptance of the prices, product descriptions and these General Conditions of Sale.

Orders will be accepted up to the limit of available stocks. In case of product unavailability, the Online Store undertakes to inform the User as soon as possible.

The data contained in the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.

Orders are valid for 2 days, except for promotional campaigns that define another period. If payment is not received within this period, the order will be cancelled.


ARTICLE 3. PAYMENT
Available payment methods include Multibanco, Mbway and Payshop, processed by Ifthenpay ( https ://ifthenpay .com/ ).


ARTICLE 4. PRICES
Prices are expressed in Euros, with all taxes and fees included, considering the VAT in force on the date of payment.

In the event of a price increase, the User will be informed and may choose to cancel or continue the order (paying the difference).
Price reductions will be clearly identified (sales, promotions or clearances) with information on the duration and communication to the competent authorities, if applicable.


ARTICLE 5. DELIVERY AND SHIPPING INFORMATION
Delivery is carried out by the transport company DPD or a similar company.
Shipping costs are calculated prior to checkout.
The Online Store ships to all regions of the world.


ARTICLE 6. COMPLAINTS
The consumer can resort to the Consumer Conflict Arbitration Center (see the "Conflict Resolution" section in the Online Store) or fill out the Complaints Book (available in the corresponding section).


ARTICLE 7. RIGHT TO FREE RESOLUTION
The User has the right to terminate the contract within 14 calendar days after receipt of the goods.
To exercise this right, you must send a communication via email or registered letter to the address indicated in the Preamble.

The refund will be made within 14 days after the goods have been returned in perfect condition. The return costs are the responsibility of the User.


ARTICLE 8. EXCEPTIONS TO THE RIGHT OF FREE RESOLUTION
It will not be possible to exercise the right of free resolution in the cases provided for in article 17 of Decree-Law no. 24/2014, such as:

  • Personalized or custom-made goods;
  • Sealed products opened after delivery for health or hygiene reasons;
  • Digital content not provided on a material medium, the execution of which begins with the express consent of the consumer, among others.

ARTICLE 9. EXCHANGE AND RETURN POLICY
Products may be returned within 14 days of receipt, provided they are in their original condition, with packaging and labels intact.
For exchanges, the customer must return the product and make a new purchase.

Return costs are the customer's responsibility, unless there is an error or defect attributable to the Online Store.
Items on sale, on promotion or themed (e.g. Christmas, Halloween) cannot be exchanged or returned.


ARTICLE 10. PRIVACY POLICY
The processing of personal data will be carried out in accordance with the Privacy Policy defined in the Online Store.
